March 15, 2025 – OpenAI and Elon Musk have agreed to fast-track their legal battle over the artificial intelligence company’s transition to a for-profit model, setting the stage for a high-profile courtroom showdown later this year.
A joint filing in the U.S. District Court for the Northern District of California on Friday confirmed that both parties had proposed a trial in December, but delayed a decision on whether a judge or jury would ultimately decide the case. Earlier this month, the court denied Musk’s request to halt OpenAI’s for-profit transition but approved an expedited trial for autumn 2025.
The Lawsuit at a Glance
Musk, who co-founded OpenAI alongside Sam Altman in 2015 but left before it became a dominant AI force, filed the lawsuit last year. He accused OpenAI of abandoning its founding mission—to develop AI for the benefit of humanity rather than corporate profit.
OpenAI and CEO Sam Altman have denied the claims, arguing that Musk is attempting to hinder a key competitor.
“We welcome the court’s March 4 decision rejecting Elon Musk’s latest attempt to slow down OpenAI for his personal benefit,” the AI firm stated in a blog post Friday.
The Fight Over OpenAI’s Future
At the heart of the case is OpenAI’s transition to a for-profit model, which the company insists is necessary to secure funding and maintain its competitive edge in the AI industry.
